I've never heard of criminals using Google Earth to spy on people.
The problem is that the images in Google Earth are old. And you don't know exactly when an image was taken.
Many people are now sharing their location in other applications, like foursquare. Unlike Google Earth, these updates are given in real-time. This allows criminals to see when you are not home...
